Monash Bike Share Rental Agreement & Waiver
Monash BikeShare Membership Agreement
This membership agreement is between BikeShare Pty Limited (collectively, “Monash BikeShare”, “Our”, “We”, or “Us”), and the person who clicks the “I Accept” button below (“Member”, “You”, or “Your”). The parties agree as follows:
Acceptance. By clicking “I Accept”, You certify that (1) You are at least 18-years old or (2) You are the parent and/or legal guardian of the Member, who is at least 16-years old, as of the date You click “I Accept”. By clicking “I Accept”, You (1) acknowledge that You have read and understand this agreement and (2) accept and agree to all the terms and conditions of this agreement.
Service. We offer a service comprised of a self-serve bicycle rental system, bicycles, and related equipment, personnel, and information (collectively, “Service”). In consideration of Your use of the Service, We require that You agree to all the terms and conditions in this agreement, which are intended to promote the safe use of Monash BikeShare bicycles (“Bicycles”), and which apply to all Members.
Modifications to Agreement. We reserve the right to unilaterally amend, modify, or change this agreement (each a “Modification”), at any time and from time to time, in Our sole discretion, without Your consent. Upon any Modification, We will notify You via email of such Modification. By continuing to use the Service after any Modification, You agree to be bound by all such Modifications.
Term, Termination. This agreement is effective when You pay Your Membership Fee and automatically renews upon expiry of the Membership plan chosen by You unless earlier terminated in accordance with this agreement; provided, however, that Your payment obligations shall survive any termination. At any time and from time to time, and without Your consent, We may unilaterally terminate Your right to use the Service, in Our sole discretion and without any notice or cause. If We terminate this agreement without notice or cause, then You will be entitled to a pro rata refund of Your Membership Fee (defined below) for the Membership period in effect as of the date of such termination. If You terminate this agreement, then You will not be entitled to any refund.
Hubs & System Areas. Members may use the Service in those geographic areas designated on the Website for the purposes of renting, locking, and returning Bicycles (“System Area”). Bicycles may be rented, locked, and returned to any bicycle rack or other secure fixture permitted for locking bicycles (“Bike Rack”) located within any specified System Area or Hub. Fees will apply if Bicycles are not returned within a specified System Area or Hub (see Other Fees and Charges later in this agreement).
Membership Account. Before You can use the Service, You must (1) purchase a membership for the Service (“Membership”) and (2) create a Membership account (“Account”) through the Website or Our mobile device application (“Mobile Application”). You must have a credit or debit card (Visa, MasterCard, or American Express), a bank account or the wherewithal to deposit funds in an account designated by Us to purchase a Membership and create an Account. To create an Account, You must complete a registration form through Website or Mobile Application. You can access Your history of using the Service by logging into Your Account on the Website or Mobile Application.. When You subscribe to the Service, We will charge Your credit card, debit card or bank account (or require you to deposit funds in an account designated by Us) the total amount of the Membership you have subscribed for that is in effect as of the date of such subscription (“Membership Fee”). In respect of Hourly Rate fees, We may at our sole discretion debit your credit or debit card or bank account for an amount no greater than your Membership Fee as prepayment against future fees that will be incurred by You.
Membership Fees and all other applicable fees are as per the attached schedule and listed on the Website and are subject to applicable goods and services taxes (GST) and other local government charges, which may be charged and collected by Us. You may not use the Service until Your credit or debit card or other method of payment You make clears. We will not charge your credit or debit card until the Bicycles are available for You to use.. Your Membership will be automatically renewed and the Membership Fee will be deducted at the expiry of Membership You subscribed for. If You wish to discontinue automatic renewal of Your Membership, You may do so through the Website or Mobile Application.
Payment Matters. You must input a valid credit card or debit number and expiration date, or required bank account details when You create Your Account. You represent and warrant that You are authorised to use the credit or debit card or bank account associated with Your Account. You hereby authorise Us to charge such credit or debit card or bank account for all expenses incurred on Your Account, including without limitation all Other Fees and Charges (found later in this agreement). In the event that the expenses incurred on Your account are not paid in full, You authorise Us to take any necessary actions, including legal actions, to recover monies owed to Us. You will be responsible for all our costs of collection, including reasonable legal fees, if you do not pay amounts owed hereunder when due. If You dispute any charge on Your Account, then You must contact Us within ten days of receiving Your statement containing the disputed charge. You have an ongoing duty to keep an authorised credit or debit card or bank account on file with Us during Your Membership period and to update all changes relating to Your credit or debit card or bank account through the Website or Mobile Application. All denials of a transaction by a Member's bank, all holds, and all other similar issues are the Member's sole responsibility and should be dealt with between the Member and such Member’s bank.
Availability of Service. We will make every effort to provide the Service, but We do not guarantee that the Service will be available at all times, as use of Bicycles by other Members, repairs, force majeure events, or other circumstances might prevent Us from providing the Service. Access to Bicycles is conditioned upon the availability of Bicycles in a Hub. We do not guarantee, represent, or warrant the availability of the Service or the availability of any Bicycle in any Hub or System Area. Members should use the Website or Mobile Application to check the inventory of Bicycles available in a Hub or System Area. You agree that We may require You to return a Bicycle at any time and that You shall comply with any such requirement.
State of Good Repair. We will make every effort to provides Bicycles that are usable and in a state of general good repair. Before using a Bicycle, You shall inspect such Bicycle for defects and report to Us any such defect. You must report defects to Us by using the repair function on the keypad of the Bicycle (“Keypad”). If You notice a Bicycle with a defect, You must use a different Bicycle.
Rentals, Reservations, Unlocking and Locking Bicycle. You agree that all Bicycle rentals are subject to the terms and conditions of this agreement. You must use the Website, Mobile Application, or a Keypad to make a Reservation to rent a Bicycle. You must make a Reservation before You can unlock a Bicycle. If You make a Reservation on a Keypad, You must enter Your Account number and PIN into the Keypad to unlock the Bicycle. If You make a Reservation through the Website or Mobile Application, You must enter Your PIN to unlock the Bicycle. After entering Your Account number and/or PIN into the Keypad, You will have 30 seconds to remove the Bicycle’s locking unit (“Lock”) from the wheel of the Bicycle. The Lock will reengage if You do not remove the Lock within 30 seconds after entering Your Account number and/or PIN, and You must re-enter Your Account number and/or PIN to disengage the Lock. If You leave a Bicycle unattended at any time for any reason, You are responsible for securing the Bicycle to a Bike Rack using the Lock to protect against theft of the Bicycle. You hereby agree to ensure that the Lock is securely attached to a Bike Rack. You shall not leave any Bicycle unattended or unsecured at any location at any time for any amount of time for any reason.
Returning Bicycle. To return a Bicycle, You must secure the Bicycle to a Bike Rack within a Hub or System Area. Extra charges apply if the Bicycle is not secured to a Bike Rack within a Hub or System Area (see Other Fees and Charges later in this agreement). It is Your responsibility to make sure that the Bicycle is secured to the Bike Rack by the Lock. If the signal light next to the Lock on the Keypad is green, the Bicycle has been securely locked and returned. If the signal light next to the Lock on the Keypad does not turn green, the Bicycle is not securely locked and returned, and You must try again to lock the Bicycle. If after several unsuccessful attempts to securely engage the Lock when returning a Bicycle, You must contact Us using the details on the Website for assistance. Any Bicycle that is not properly locked and secured to a Bike Rack within a Hub or System Area shall be considered not returned and remains the sole responsibility of the Member who rented such Bicycle, and the Hourly Rate fees indicated herein and on the Website will be charged until the Bicycle is properly locked and returned.
Rental Period; Damaged, Lost, or Stolen Bicycle. You understand and agree that the purpose of the Service is to provide short-term access to Bicycles. The rental period of any one Bicycle shall be limited to a period within the operating hours designated by Us on the Website, such period beginning when You unlock such Bicycle and ending when such Bicycle is locked and returned (“Rental Period”), unless You have made prior arrangements with Us. If You do not properly lock and return the Bicycle, then the credit or debit card or bank account associated with Your Account will be charged (see Other Fees and Charges later in this agreement), and Your Membership may be terminated. If a Bicycle You rent is damaged, lost, or stolen during the Rental Period, then the credit or debit card or bank account associated with Your Account will be charged at our sole discretion up to $2,500 per damaged, lost or stolen Bicycle. Prior to charging Your credit or debit card or bank account for a damaged, lost or stolen Bicycle, We will (1) attempt to locate the Bicycle and (2) will attempt to contact You, using the contact information You provided in Your Account. If a lost or stolen Bicycle is returned to Us within 30 days of charging You, then any fees charged for a lost or stolen Bicycle will be promptly refunded; provided, however, that We may retain a portion of the such fees to compensate Us for reasonable and necessary costs included but not limited to transport and repairs to such Bicycle if such Bicycle is not returned to Us in good and working condition. You shall (1) report any lost or stolen Bicycle to Us within 24 hours following such loss or theft and (2) report any such loss or theft to the local police department within 48 hours of such loss or theft. If You promptly report a lost or stolen Bicycle to Us, file a police report with respect to such loss or theft, and forward Us a copy of such police report within five business days of filing such police report, then We may, in Our sole discretion, waive Our right to charge You fees for a lost or stolen Bicycle. Any use of a Bicycle exceeding the Rental Period shall be deemed a loss or theft of such Bicycle unless and until such Bicycle is found and/or returned to a Hub. Assumption of Risk. You are solely and fully responsible for safely operating a Bicycle at all times. You agree that Bicycles are machines that may malfunction, even if a Bicycle is properly maintained, and that such malfunction may cause injury or damage. You understand that using a Bicycle can be dangerous and involves inherent risks, including risks of property damage, physical injury, or death (collectively, “Risks”) of You or others. You hereby freely and voluntarily assume all Risks, including the Risks of using a Bicycle with any defects. You understand that wearing a helmet and other safety equipment does not eliminate the Risks but that under certain circumstances using a helmet and other safety equipment may reduce the risk of injury or death. You agree that if Your use of the Service and/or a Bicycle, or use by others of a Bicycle rented by You, causes any injury or damage to another person or property, then You may be liable for all resulting injuries, damages, and related costs. By choosing to use the Service and/or a Bicycle, You assume full and complete responsibility for all related risks, dangers, and hazards, and You agree that We and all other Released Parties (defined below) are not responsible for any injury, damage, or cost caused by You with respect to any person or property (including the Bicycle itself) including as a result of any act, omission or negligence to the extent permitted by law.
Prohibited Acts. You shall not:
Carry or wear any briefcase, backpack, bag, article of clothing, or other item while using a Bicycle to the extent carrying or wearing any such item impedes Your ability to safely operate a Bicycle;
Use any mobile telephone, handheld computer, text messaging device, portable music player, or any other device while using a Bicycle that may distract You from safely operating a Bicycle;
Use a Bicycle while under the influence of alcohol, drugs, medication, or any other substance that may impair Your ability to safely operate a Bicycle;
Use a Bicycle for racing, riding off-road, or any use other than safe operation on public or private roads or property and designated bicycle routes;
Carry any additional person or any animal in the front basket of a Bicycle or on a Bicycle;
Place large items or items weighing more than 10 kilos, alone or in the aggregate, in the front basket of a Bicycle;
Press the “Repair” button recklessly, negligently or as a result of misconduct;
Violate any applicable federal, state, or local law, including any such law applicable to the use of bicycles; Use the Service or any Bicycle for advertising or commercial purposes;
Dismantle or modify a Bicycle (including its Lock or Keypad) in any way, other than to adjust the seat height of the Bicycle;
Ride a Bicycle if You weigh more than 127 kilos, which is the maximum weight limit for the safe operation of a Bicycle;
Operate a Bicycle in extreme weather conditions, including snow, hail, and electrical storms, which make it more dangerous to operate a Bicycle;
Operate the Service or a Bicycle in any way other than its intended purpose;
Allow others to use a Bicycle rented by You; and
Transfer or allow others to use Your Account number and/or PIN or any other Account information.
Representations and Warranties of Member. You make the following representations and warranties to Us:
You are (A) a safe and competent bicycle operator; (B) sufficiently fit and physically capable to safely ride a bicycle without any risk to Your health; (C) knowledgeable about the operation of a bicycle; and (D) knowledgeable about, and will at all times abide by, the laws pertaining to bicycles operated within the City of Melbourne, Monash University campuses, the State of Victoria and the Commonwealth of Australia;
We are not responsible for providing or maintaining bicycle lanes or any other place where You may ride Bicycles, and We and the other Released Parties do not guarantee that there will always be a safe place to ride a Bicycle;
You agree that access to the Service is denied to any person less than 16-years old, whether or not accompanied by a parent or guardian. Minor persons who are 16-years old or older (“Minor”) may use the Service, but only if the Service is subscribed for by, and such Minor is under the responsibility of, such Minor's parent or legal guardian. By authorising use of the Service by a Minor, such Minor’s parent or legal guardian (A) agrees that such person is fully and completely responsible and liable for all injuries, damages, costs, and expenses arising from or related to such Minor's use of the Service, and (B) represents, warrants, and agrees that such person is the Minor's parent or legal guardian and that such person and such Minor have all accepted and agreed, as a Member, to all terms and conditions of this agreement;
You shall report to the police and to Us (using Our details provided on the Website) as soon as possible, but in no event later than 24 hours, after the occurrence of (A) any crash, damage, loss, or personal injury while using a Bicycle, (B) any vandalism of any of a Bicycle, and (C) any stolen or lost Bicycle;
You are fully and completely responsible for all charges, damages, and injuries that arise from or relate to Your use of Your Account before (A) termination of Your Account by Us or You under this agreement, or (B) You notify Us that the confidentiality of Your Account information has been compromised;
You agree that bicycles are machines that may malfunction, even if the Bicycle is properly maintained, and that such malfunction may cause injury. Before using a Bicycle, You shall conduct a safety inspection of such Bicycle’s (A) tire pressure; (B) trueness of the wheels; (C) proper functioning of all brakes and lights; (D) proper attachment of the seat, pedals, wheels, handlebars, and basket; and (E) good condition of the frame;
Safely operate a Bicycle at all times during the Rental Period;
You will act honestly and in good faith at all times when you have a Membership;
When using the Service or Bicycle, You will exercise due care and caution in a manner so as to avoid acts or circumstances that may damage, compromise or render inoperable the Service or the Bikes;
Upon noticing any mechanical or other problem or safety issue with any Bicycle, notify Us by pressing the “Repair” button on the Keypad; and
Upon the failure of the Lock, contact Us for further instructions using the contact details on the website.
Helmets. You acknowledge that wearing an approved helmet, properly sized, fitted, and fastened, while cycling may protect against an injury, or may lessen the severity of an injury, caused by an impact to the head. However, bicycle helmets are not 100% effective, do not protect against all head injuries, and do not protect against other injuries. We recommend that all riders wear an approved helmet that has been properly sized, fitted, and fastened, according to the manufacturer's instructions. We do not represent or warrant the quality or safety characteristics of any helmet.
Member Information. All personally identifiable information that is held by Us that pertains to You, including Your name, address, phone number, email address, and credit and debit card numbers, will be kept confidential by Us; provided, however, that (1) if there is any accident where a Member is unable to communicate personal information to the appropriate authorities, then We may, in Our sole discretion, provide Your name, address, phone number, and other important information to such authorities; (2) if We receive a subpoena from any court or other authority, then We will provide all requested information in accordance with applicable law; (3) We or other third parties may provide you with information about other services offered by third parties which We think you may find interesting; and (4) We may disclose aggregate and other data about Members in accordance with applicable law or request from Monash University, including general latitude and longitude data for Member addresses (provided this would not allow any individual's address to be separately identified). You also authorise Us to obtain private or personal information about You (including without limitation Your residential address, postal address, full name, email addresses and contact phone numbers provided) from Monash University or any other party in the event that we are unable to contact you in relation to Your account.
Release. In consideration for Your use of the Service, You, for and on behalf of You and Your heirs, administrators, executors, successors and assigns (“Releasors”), agree to, and hereby do, release, waive, and discharge all Claims (defined below) which may arise against Us, Social Bicycles LLC, Monash University, all officers, directors, managers, shareholders, members, owners, employees, and agents of each of the foregoing, and the successors, assigns, and heirs of each of the foregoing, (the “Released Parties”) from all Claims, direct or indirect, arising out of or related to the Service, Bicycles, or related information, or Your use of the Service, Bicycles, or related information, including Claims based on any Released Party’s alleged or actual negligence, breach of this agreement, or breach of any express or implied warranty (collectively, the “Released Claims”), and do hereby covenant not to sue the Released Parties for the Released Claims. “Claims” means, collectively, any and all claims, injuries, demands, liabilities, disputes, causes of action (including statutory, contract, negligence, or other tort theories), proceedings, obligations, debts, liens, fines, charges, penalties, contracts, promises, costs, expenses (including attorneys' fees, whether incurred at trial, on appeal, or otherwise), damages (including consequential, compensatory, or punitive damages), or losses (whether known, unknown, asserted, unasserted, fixed, conditional, or contingent).
Indemnification. Releasors shall indemnify the Released Parties, and will hold harmless the Released Parties against any Claim which the Released Parties may incur in connection with the Service, Bicycles, or related information, or assertion of a Released Claim by Releasors, or third parties in connection with Your use of the Service, Bicycles, or related information.
Limitation on Liability. YOU DO HEREBY ACKNOWLEDGE AND AGREE THAT, EXCEPT AS MAY OTHERWISE BE LIMITED BY THE LAWS OF VICTORIA OR THE COMMONWEALTH OF AUSTRALIA, WE AND ALL OTHER RELEASED PARTIES ARE NOT RESPONSIBLE OR LIABLE FOR ANY CLAIM, INCLUDING THOSE ARISING OUT OF OR RELATING TO (1) ANY RISK, DANGER, OR HAZARD DESCRIBED IN THIS AGREEMENT; (2) YOUR USE OF, OR INABILITY TO USE, THE SERVICE, BICYCLES, OR RELATED INFORMATION; (3) YOUR BREACH OF THIS AGREEMENT OR YOUR VIOLATION OF ANY LAW; (4) ANY NEGLIGENCE, MISCONDUCT, OR OTHER ACTION OR INACTION BY YOU; (5) YOUR FAILURE TO WEAR A HELMET WHILE USING A BICYCLE, OR (6) ANY NEGLIGENCE, MISCONDUCT, OR OTHER ACTION OR INACTION OF ANY THIRD PARTY. YOU DO HEREBY WAIVE ALL CLAIMS WITH RESPECT TO ANY OF THE FOREGOING, INCLUDING THOSE BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTORY, OR OTHER GROUNDS, EVEN IF WE OR ANY OF THE OTHER RELEASED PARTIES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH CLAIMS. THE TOTAL LIABILITY OF US AND ALL OTHER RELEASED PARTIES FOR ALL CLAIMS, INCLUDING THOSE BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTORY, OR OTHER GROUNDS, IS LIMITED TO THE SUM OF $100. WE SHALL NOT BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE, OR SPECIAL DAMAGES DIRECTLY OR INDIRECTLY ARISING OUT OF THIS AGREEMENT, THE SERVICE, ANY BICYCLE, OR ANY RELATED INFORMATION. SOME JURISDICTIONS DO NOT ALLOW FOR LIMITED LIABILITY OR EXCLUSION OF IMPLIED WARRANTIES; AND, IF ANY SUCH LAWS APPLY TO YOU, THEN SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MIGHT NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
Disclaimers. YOU HEREBY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE, OUR BICYCLES, OR RELATED INFORMATION IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, AND WITH RESPECT TO YOUR USE OF THE SERVICE, BICYCLES, OR RELATED INFORMATION, WE AND ALL OTHER RELEASED PARTIES DISCLAIM ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE SERVICE, BICYCLES, AND RELATED INFORMATION ARE PROVIDED "AS IS" AND "AS AVAILABLE" (AND YOU RELY ON THEM SOLELY AT YOUR OWN RISK). WE AND ALL OTHER RELEASED PARTIES DO NOT REPRESENT OR WARRANT THAT THE SERVICE, BICYCLES, OR RELATED INFORMATION WILL BE IN GOOD REPAIR OR ERROR-FREE, AND DELAYS, OMISSIONS, INTERRUPTIONS, OR INACCURACIES COULD EXIST WITH RESPECT TO THE SERVICE, BICYCLES, OR RELATED INFORMATION. YOU ASSUME FULL RESPONSIBILITY AND RISK OF LOSS FOR USING THE SERVICE, BICYCLES, OR RELATED INFORMATION, AND WE AND ALL OTHER RELEASED PARTIES ARE NOT LIABLE FOR ANY CLAIM ATTRIBUTABLE TO ANY OF THE FOREGOING. YOU ASSUME FULL AND COMPLETE RESPONSIBILITY AND LIABILITY FOR ALL CONSEQUENCES AND CLAIMS OF ANY KIND OR NATURE WHATSOEVER RELATED TO YOUR DAMAGED, STOLEN OR LOST BICYCLE.
Severability. If any provision of this agreement is held to be unenforceable for any reason, it shall be adjusted rather than voided, if possible, in order to achieve the intent of the parties to the extent possible. In any event, all other provisions of this agreement shall be deemed valid and enforceable to the fullest extent possible. No Waiver. No waiver of any breach of any provision of this agreement is a waiver of any other breach or of any other provision of this agreement. The terms of this agreement may be waived or amended only in writing and only by the party that is entitled to the benefits of the term being waived or amended.
Cumulative Remedies. All rights and remedies granted under or referred to in this agreement are cumulative and non-exclusive, and resort to one does not preclude resort to another or to any other right or remedy provided by law.
Notices. We may contact You at Your mailing address ,email address or phone numbers on file with Us. You may contact Us by writing, calling, or emailing Us at the mailing address, telephone number, and email address indicated on the Website.
Any notice required or permitted to be given to any party to this agreement shall be deemed to have been duly given for all purposes if (1) in writing and delivered by hand against receipt, or sent by certified or registered mail, postage prepaid, return receipt requested, or (2) sent by electronic means to such party. The date of giving any such notice shall be the earlier of the date of actual receipt, or five business days after such notice is sent, or, if sent in accordance with clause (2), the business day next following the day such notice actually transmitted. Entire Agreement. This agreement constitutes the entire agreement and supersedes all prior understandings and agreements, written or oral, of the parties with respect to the subject matter hereof. This agreement prevails in the event of any inconsistencies between this agreement and the Website.
Force Majeure. We will not be liable to You because of delays or failures to perform under this agreement to the extent that any such delays or failures result from any cause beyond Our reasonable control. Survival. Your unfulfilled obligations arising during Your Membership, all rights in favour of Us, and the Release, Indemnification, Limitation on Liability, Indemnification, Disclaimer and No Waiver clauses will survive termination of this agreement.
Governing Law. This agreement is governed by the laws, and subject to the exclusive jurisdiction, of New South Wales.
Membership Fee Schedule
Base Membership Fees and Extra Usage Fees
Semester Plan is good until 28 February 2017, Membership Fee costs $39, Daily free time is 60 minutes, hourly rate is $3.50 an hour prorated.
Annual plan is good for 365 days, Membership Fee is $62. Daily free time is 60 minutes, hourly rate is $3.50 an hour prorated.
Pay-As-You-Ride plan is good for 365 days, Membership Fee is $0, Daily free time is 0 minutes, hourly rate is $7 an hour prorated.
Trial Plan is good between 27 July and 9 August 2015, Membership Fee is nil, cumulative free time is 180 minutes during the trial period. Usage in excess of 180 minutes is charged at the hourly rate of $7 prorated.
The maximum hiring period (operating hours) for a Bicycle is 24 hours per day 365 days per year. The Hourly Rate is pro-rated on the basis of minutes used. For example, if you use the Bicycle for 10 minutes, you are only charged for 1/6th of the Hourly Rate.
Other Fees and Charges
For all above Plans, the following fees and charges apply:
Bike locked outside System Area: Bicycles locked outside Clayton Campus after ride completed during operating hours indicated on Website will incur a $50 fee for each incident
Bike locked within System Area but not to a Bike Rack: Bikes locked within Clayton Campus grounds but not locked to a Bike Rack will incur a $25 fee for each incident
Unauthorised user: Any rider that is not the registered Member of the Reservation will incur a $50 fee for each incident unless the rider is using a bike under a department plan
Bike locked to itself: If the bicycle is not securely locked to an immovable object, the member will incur a $50 fee for each incident
Bike modified, damaged, lost or stolen: If the bicycle is modified, damaged, destroyed or cannot be found whilst in use by Member, member will incur a $2,500 fee for each incident
Administration fee for Membership Fees unpaid: Payment of any amounts You owe Us are not received when due, member will incur a $10 fee for each incident
Incorrect service callout: Incorrectly reporting that there is a problem with a Bicycle (e.g. pressing “Repair” button on keypad) and no such problem exists, member will incur a $100 fee for each incident
Payment Timing- Your credit/debit card or bank account will not be charged until the Monash BikeShare Scheme is in operation.
Secure Payments- All payments are securely processed using Braintree (wholly owned subsidiary of PayPal). We never store raw magnetic stripe, card validation code or PIN block data.
Auto renewing membership- For your convenience, our membership plans renew automatically and you can cancel at anytime.
